Individuals with Disabilities Education Act (IDEA)
Central part of special education law for students with disabilities ages 3-21. Requires a Free Appropriate Public Education (FAPE) that prepares students for post-secondary education, employment, and independent living.
Requirements:
- Educational programming to be individualized to the specific child
- Designed to meet the unique needs of the child
- Provides access to the general/assigned curriculum
- Access to accommodations, services, and related services
- Meets grade level or assigned standards established by the state
- Child receives documented educational benefit (makes the progress)
Rights of Parents Under IDEA:
- Must be informed of Procedural Safeguards in their native language
- VDOE provides procedural safeguards in Spanish and many other languages including Arabic, Chinese, Urdu, Farsi, Korean, and Vietnamese
- Review educational records
- Equal members in the IEP team, alongside school members
- Equal part of all aspects of their child’s educational program
- Have their complaints heard within the state agency
- Request mediation
- Request due process hearing
