Individuals with Disabilities Education Act (IDEA)

Central part of special education law for students with disabilities ages 3-21. Requires a Free Appropriate Public Education (FAPE) that prepares students for post-secondary education, employment, and independent living.

Requirements:

  • Educational programming to be individualized to the specific child
  • Designed to meet the unique needs of the child
  • Provides access to the general/assigned curriculum
  • Access to accommodations, services, and related services
  • Meets grade level or assigned standards established by the state
  • Child receives documented educational benefit (makes the progress)

Rights of Parents Under IDEA:

  • Must be informed of Procedural Safeguards in their native language
  • VDOE provides procedural safeguards in Spanish and many other languages including Arabic, Chinese, Urdu, Farsi, Korean, and Vietnamese
  • Review educational records
  • Equal members in the IEP team, alongside school members
  • Equal part of all aspects of their child’s educational program
  • Have their complaints heard within the state agency
    • Request mediation
    • Request due process hearing
